Terms of Service

1. Agreement to Terms

By accessing or using Torqvoice ("the Service"), operated at torqvoice.com and app.torqvoice.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Right to Amend

Torqvoice reserves the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

3. Definitions

• Account Holder: An individual or entity that registers for and operates a Torqvoice account.
• Customer Data: All information, including customer records, vehicle data, invoices, quotes, and files uploaded or entered through the Service.
• Invoice Recipient: A third party who receives and views invoices or quotes generated through the Service.

4. Eligibility and Responsibility

You must be at least 18 years old to use the Service. Account holders are responsible for maintaining the confidentiality of their credentials, for all activity that occurs under their account, and for compliance with all applicable laws and regulations.

5. Service Description

Torqvoice provides a workshop management platform for automotive service businesses. The Service includes work order management, invoicing, quoting, customer management, vehicle tracking, and inventory features. Torqvoice is available as a cloud-hosted service and as self-hosted open-source software.

6. Data Ownership

You retain full ownership of all Customer Data stored in your Torqvoice account. Torqvoice does not claim ownership over your data. We only access your data as necessary to provide, maintain, and improve the Service.

7. Subscriptions and Billing

• Free accounts are available with limited features as described on the pricing page.
• Paid plans (Torq Pro, Enterprise) are billed annually. You may cancel at any time; access continues until the end of the billing period.
• Refunds are available within 30 days of the initial purchase. No refunds are issued after the 30-day period.
• Free accounts inactive for more than 6 months may be subject to deletion with prior email notice.

8. Prohibited Activities

You agree not to use the Service to:

• Engage in fraud, impersonation, phishing, or deceptive invoicing.
• Send invoices or quotes for services not rendered or goods not delivered.
• Violate any applicable laws or regulations.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated tools to scrape, crawl, or abuse the platform.

Violation of these terms may result in immediate account termination without notice.

9. Self-Hosted Usage

Torqvoice is available as open-source software under its published license. Self-hosted users are solely responsible for their own server infrastructure, security, backups, and compliance. Torqvoice provides no warranty or support for self-hosted installations unless covered by a separate support agreement.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Torqvoice shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Torqvoice, its officers, and contributors from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes shall be resolved in the courts of Norway.
